What Legal Pot in Washington Will Look Like - Reason

Washington's marijuana legalization initiative, which takes?effect on December 6, is broadly similar to Colorado's: Both initiatives eliminate penalties for possession of up to an ounce by adults 21 or older, and both call for state-licensed pot shops, in Washington's case to be regulated by the state liquor control board, which is supposed to adopt regulations by December 2013 and start issuing licenses in 2014. But Washington's Intitiative 502 is considerably more restrictive and prescriptive than Colorado's Amendment 64. Here are some of the significant differences:

Home cultivation.?Unlike Amendment 64, I-502, does not allow people to grow their own pot. Alison Holcomb, director of the Yes on I-502 campaign, says pre-drafting research indicated that voters were not receptive to home cultivation. Since "marijuana isn?t quite yet out of the black market, and won't come out of the black market, even under I-502, until other states make it a legal product and the federal prohibition goes away,"?she says, "there is still concern among parents, families living in neighborhoods, saying 'I'm not quite ready for my next-door neighbor to start growing marijuana in their basement.'"

DUI standards.?I-502 establishes a per se standard for driving under the influence of marijuana: five nanograms of THC per milliliter of blood. Amendment 64 does not address the issue, except to say that "driving under the influence of marijuana will remain illegal." Under current Washington law (which is similar to Colorado's), Holcomb says, an arrest requires evidence of impairment, and a conviction requires evidence of consumption, but neither is tied to a particular THC level. The more specific standard can help or hurt defendants, depending on the situation. Pro-legalization critics of I-502 worry that regular consumers, such as patients who use marijuana for symptom relief every day, may hit the five-nanogram limit even when their driving ability is not impaired. Holcomb emphasizes that blood cannot be drawn for a test without reasonable suspicion that a driver is impaired, and she argues that jurors "might be skeptical that the person was actually impaired [if] the results were not at that threshold level."?But she concedes that any per se rule, whether for marijuana or alcohol, carries a risk of punishing people who do not in fact pose a public safety threat.?

Retail restrictions.?While Amendment 64 leaves the details of regulating pot shops to the Colorado Department of Revenue, I-502 includes specific rules aimed at making the stores as unobtrusive and uncontroversial as possible: no consumption on the premises, no products visible from the street, no identification beyond a single plain sign of specified size, and no outdoor ads on publicly owned property (including mass transit systems) or "within one thousand feet of the perimeter of a school grounds,?playground, recreation center or facility, child care center, public?park, or library, or any game arcade admission to which is not?restricted to persons aged twenty-one years or older." That same location restriction applies to the stores themselves. The idea, says Holcomb, is to make the privately operated pot shops resemble old-style state-run liquor stores?"very bland, very boring," and inconspicuous, so "you have to specifically seek it out to go there and buy marijuana....We don't want to treat people like criminals for making the choice to use marijuana, and at the same time we don?t want to promote marijuana use."

Taxes. Amendment 64 tells the state legislature to impose an excise tax "at a rate not to exceed fifteen percent" on sales of marijuana to retailers. That cap expires on January 1, 2017. But since a 1992 amendment to Colorado's constitution requires that all tax increases be approved by voters, it is not clear whether this levy actually will be imposed. Colorado Attorney General John Suthers says Amendment 64 did not comply with the constitution's requirements for new taxes, so a second vote will be necessary before the state can collect any revenue from marijuana sales. Washington has no such requirement, and the tax imposed by I-502 is much heavier: 25 percent at each of three levels (grower to processor, processor to retailer, and retailer to customer). As a result, prices paid by consumers, taking into account wholesaler and retailer markups (which add to the taxable price), will be more than double what they would be without taxes. Then again, production costs and markups should be much lower in a legal market, even with the threat of federal prosecution. A 2010 RAND Corporation analysis of marijuana legalization in California suggested pretax retail prices might be one-tenth the black-market price, in which case even an effective tax in the range of 100 percent to 200 percent may not seem very onerous, although it will create a strong incentive for evasion.

There is at least one way in which Washington's initiative is more permissive than Colorado's: Unlike Amendment 64, it does not let local governments ban marijuana stores within their jurisdictions. In fact, it charges the Washington Liquor Control Board with ensuring "adequate access to licensed sources of?useable marijuana and marijuana-infused products to discourage?purchases from the illegal market." Holcomb says allowing local bans would undermine that goal. Furthermore, Washington is taking a bigger leap than Colorado, which already has state-regulated medical marijuana dispensaries, many of which may decide to get into the recreational market. Washington's medical marijuana law, by contrast, does not explicitly authorize dispensaries, although as in California they operate in more tolerant jurisdictions (such as Seattle) as patient-caregiver collectives. Another significant difference that could eventually make Washington's new law either stricter or more liberal than it is now: Unlike Amendment 64, which can be changed only by another constitutional amendment, I-502 can be amended by the state legislature. For the first two years after passage, amending an initiative requires a two-thirds majority, but after that a simple majority suffices.?

Three-Row SUVs Don't Measure Up to Minivans' Family-Friendliness

A little over two years ago, I was pregnant with my second child and shopping for a new family car. Seeing our obviously growing family, the well-meaning salesman brought us over to a minivan. The second those power doors slid open, I quickly corrected him: "No, no. This is only my second baby. I am not driving that."

Fast-forward two years and two babies later, and I'm now driving a minivan; I've jumped the fence from "No way, no how" to "No, really; it's awesome."

So, how does that happen? How do those who were once emphatically against a minivan suddenly give in? The push always seems to come from baby No. 3 and that few vehicles can fit three child-safety seats across the second row. That leaves two viable options: a minivan or a three-row crossover/SUV.

Luckily, I review family cars for a living, and after nine months of test-driving the two options, my husband and I reached our conclusion: minivan, hands down.

This is why:

Power sliding doors

The fact that I don't want to open my own car doors may sound lazy, but hear me out. When you've got a baby on your hip, a diaper bag on your shoulder, a lunch pail and backpack in one hand and a squirmy 2-year-old hand in the other (and in my case, a pokey preschooler trailing behind as well), the last thing you want to do is drop everything to open each door. Also, most car doors are too heavy for my wee ones to open on their own. If, by chance, they can open the door, their little over-enthusiastic arms are going to swing that door wide open and into the Mercedes parked next to me in the parking lot.

The final word: Power sliding doors save me time and energy ? two things I could use extra doses of.

Fuel economy

While the gap between three-row crossovers' and minivans' fuel-economy numbers aren't as large as they once were, minivans still eke out better mpgs. The 2013 Honda Odyssey with a 3.5-liter V-6 and front-wheel drive gets 19/28 mpg city/highway; the same engine in the 2013 Honda Pilot with front-wheel drive gets 18/25 mpg. The 2013 Dodge Grand Caravan with a 3.7-liter V-6 and front-wheel drive gets 17/25 mpg; with a 3.5-liter V-6 engine, the 2013 Dodge Durango (photo above) gets slightly less mpgs at 16/23.

The final word: The fuel savings may seem like small potatoes, but depending on gas prices and the amount you drive, it can amount to significant savings annually.

Step-in height

While I'm happy to climb up into a trucklike SUV all day long, I'm not keen on doing that for my three kids, as well. Just a simple errand of going to the grocery store and then to the bank would require me to lift my girls a total of 18 times to get them into their child-safety seats and back down again.

The final word: My back and biceps prefer the low step-in height of a minivan, allowing my preschooler and toddler to climb in on their own. Also, minivans require a less strenuous lift of my infant's safety seat.

Seating capacity

Just because a three-row SUV has eight seat belts doesn't mean it can fit eight people comfortably. Third rows in many SUVs and crossovers are a better fit for hobbits rather than adults, especially when they're crammed into what's normally a two-row SUV. There are some larger SUVs designed specifically to carry seven or eight passengers with a third row that's appropriately sized. The Pilot (photo above) and Chevrolet Suburban are perfect examples of large, family-friendly SUVs with adult-friendly third rows.

The final word: One of the major perks of a minivan is it's designed to be a people mover with a third row that's often as comfy as the second and first.

Three kids

I may not advertise it with a Baby on Board sign, but when those doors open (whether they slide or swing), three little ones are going to pour out of the vehicle and take whatever semblance of my pre-mama life I still have with them.

The final word: While I look forward to the day when power sliding doors aren't a godsend, for now I'm quite content to swear that "I love my minivan. No, really; it's awesome!"

New York City hospitals? healthcare IT systems were severely tested in the grips of one of the worst storms to hit the city. Hurricane Sandy will serve as a reminder of the importance of having electronic medical records and access to a healthcare information exchange. For some hospitals, it will offer valuable lessons on data storage logistics and how their IT networks (and back-up generators) perform in a crisis.

New York University Langone Medical Center was forced to evacuate midstorm after a transformer explosion cut power to Lower Manhattan and back-up generators failed. The event prompted a tongue lashing from New York Mayor Michael Bloomberg. In another borough, Staten Island University?s hospitals in the North Shore Long Island Jewish Health System relied on paper-based records when power to the building where its data center is located (on the seventh floor) was shut down because of flooding.

Looking back seven years, Hurricane Katrina became the storm that demonstrated the need for digital health records because so many paper-based medical records were lost, said New York eHealth Collaborative Executive Director David Whitlinger. When the flood waters inundated hospitals, their patients? medical histories pretty much vanished. Now, Hurricane Sandy could be the storm that underscores the importance of having a health information exchange and a tested emergency plan.

New York?s SHIN-NY health information exchange connects 78 percent of hospitals in the state. Patients evacuated to other providers because of lost power or flooding would still have medical information accessible in the network that details drug prescriptions and past medical tests, for example. Whitlinger noted that although one SHIN-NY data center is in New York, another ?fully redundant? data center is in Texas and could have taken over ?within milliseconds? had its New York unit failed.

?What we have heard across the [past few] days is as patients have been moving from one hospital to another, there is a great benefit of being connected to a health information exchange,? Whitlinger said in a phone interview.

For Whitlinger, the storm?s impact on hospitals? data centers in the region underlined the relatively short amount of time since the industry began the shift to digitizing records. It also called attention to how the healthcare industry has historically underspent on health IT relative to other industries. For some providers, the storm will be a source of some instructive insights not only on how they back up their data but where they store it.

Staten Island?s two hospitals were just a couple of the providers that lost their data center. North Shore Long Island Jewish Health System runs the two hospitals that make up Staten Island University Hospital?s north and south campuses. Doug Torre, vice president of information technology at the health system, spoke to MedCity News as he was helping to bring the data center back online. He acknowledged the usefulness of the state?s health information exchange for patients being shuttled between hospitals and of providing a point-in-time snapshot of patients? health. But he added that ?running an active operational support system for a hospital requires a lot more than that,? such as lab tests, radiology tests and administering information.

Many providers across the country will be taking a hard look at how New York hospitals performed under such stressful circumstances. They might assess what they have overlooked in their own institutions and reexamine their own data storage back-up plans and the merits of alternative plans. But beyond that, they will take NYU?s experience and use it as an instructive reminder to be vigilant about ensuring their own back-up plans work before they are put to the test.
